Overview

This website (www.eyesociety.ro) is operated by SKOLD S.R.L., trading as EYE SOCIETY (referred to as "EYE SOCIETY", "we", "us" or "our"). These Terms and Conditions govern your access to and use of our website, our showroom at AFI Cotroceni, and the products and services we offer.

By accessing or using our services, you agree to be bound by these Terms together with any additional terms and policies referenced here, including our Shipping Policy, Refund Policy, and Privacy Policy. If you do not agree, please do not use our services.

Section 1 — Access and account

Use of services

You must be at least 18 years old or have legal capacity to enter into binding contracts to use our services. By using our services, you confirm that you meet these requirements.

Customer account

You may create a customer account to manage orders, save preferences and receive personalised offers. You are responsible for keeping your account credentials confidential and for all activity under your account. Please notify us immediately of any unauthorised use.

Account information

You agree to provide accurate, current and complete information when creating an account or placing an order, and to keep this information up to date.

Section 2 — Our products

Eyewear and related products

EYE SOCIETY offers a curated selection of premium eyewear and related products, including:

Sunglasses
Eyeglasses with prescription lenses fitted to order
Eyeglass frames (without lenses)
Contact lenses
Eyewear accessories

Product representation

We make every reasonable effort to display our products accurately on our website and in our showroom. However, please note that the colour and appearance of products may differ from how they appear on screen, depending on the device you use and its display settings. We do not guarantee that the appearance of any product will be identical to its representation in our online store, except where the product is found to be non-conforming or defective.

Product availability

Product descriptions and availability may change without notice. We reserve the right to discontinue any product, limit quantities offered to a single customer, or restrict orders by region or jurisdiction.

Personalised products

Eyeglasses with lenses fitted to your prescription, contact lenses with custom parameters, lenses with custom tints or treatments, and items personalised or engraved at your request are made specifically for you and cannot be returned, except in the case of manufacturing defects or non-conformity. The full list of items excluded from the right of withdrawal is set out in Section II of our Refund Policy.

Section 3 — Orders

Order process

When you place an order, you make an offer to purchase. Your order is accepted only when we send you an order confirmation email. We reserve the right to accept, refuse or cancel any order at our discretion. We must receive and process your payment before an order can be accepted. Please review your order carefully before submitting it, as we may not be able to process cancellation requests after the order has been accepted.

Order confirmation

If we are unable to accept your order or need to modify or cancel it, we will attempt to contact you using the email address, billing address or phone number you provided.

Returns and exchanges

You may return or exchange your purchase in line with our Refund Policy, within 15 calendar days from receipt and subject to the conditions set out there.

Personal use

You confirm that your purchases are for personal or household use and not for commercial resale or export, unless you have a separate commercial agreement with us.

Section 4 — Pricing and billing

Price changes

Prices, discounts and promotions may change without prior notice. The price applied to your order is the price displayed at the time the order is placed and confirmed in your order confirmation email.

VAT and taxes

Prices displayed include VAT in accordance with Romanian legislation. Prices do not include shipping, handling, customs duties or import taxes for international deliveries unless explicitly stated.

Online vs. showroom prices

Prices displayed online may differ from prices in our AFI Cotroceni showroom. For purchases made in person, the showroom price applies.

Promotions

From time to time, we may run special promotions governed by their own terms and conditions. Where there is a conflict between a promotion's terms and these Terms, the promotion's terms will prevail.

Payment obligations

You agree to provide accurate, current and complete information regarding payments and account details, and to keep them up to date. You confirm that any payment information you provide is true, that you are authorised to use the payment method, and that any charges may be processed.

Section 5 — Delivery and shipping

Delivery liability

We are not liable for delays caused by third-party carriers, customs procedures, extreme weather or other events beyond our reasonable control (force majeure). All delivery times are estimates and not guaranteed.

Transfer of risk

Once goods are handed to the carrier, ownership and risk of loss pass to you, except where loss or damage is caused by carrier fault.

Inspection on receipt

You are responsible for inspecting the parcel on receipt and refusing delivery if the packaging is visibly damaged. Please contact us within 24 hours of any issue.

Section 6 — Intellectual property

All content on our website — including text, graphics, logos, images, product descriptions and software — is owned by EYE SOCIETY or our licensors and is protected by Romanian and international intellectual property laws. You may not reproduce, distribute, modify or use this content for commercial purposes without our prior written consent.

Section 7 — Optional tools

We may provide access to third-party tools (such as virtual try-on or prescription readers). These are provided "as is" and "as available", without warranties or endorsement. We are not liable for any issues arising from your use of optional tools, which are governed by the relevant third-party providers.

Section 8 — Third-party links

Our website may contain links to third-party websites or services not owned or controlled by us. We are not responsible for the content, accuracy or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their terms and policies.

Section 9 — Website technology

We make reasonable efforts to ensure our website is available and functional, but we do not guarantee uninterrupted or error-free operation. We may suspend, modify or discontinue any feature without notice. We are not liable for any loss arising from website unavailability or technical issues.

Section 10 — Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Romanian data protection law.

Section 11 — Reviews and feedback

We welcome customer reviews and feedback about our products and service. By submitting a review, comment or any other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit and display that content in connection with our services. We reserve the right to moderate or remove any content that is unlawful, offensive or violates third-party rights.

Section 12 — Errors, inaccuracies and omissions

Error correction

Information on our website — including product descriptions, prices, promotions, shipping costs and availability — may occasionally contain errors or omissions. We reserve the right to correct any error and to modify, update or cancel orders if information is found to be inaccurate, at any time and without prior notice (including after an order has been placed).

Notification

If we cancel an order due to an error, we will notify you and refund the amount paid in full.

Section 13 — Prohibited uses

You may not use our services for any unlawful purpose or in any way that violates these Terms. Prohibited uses include:

(a) Illegal or malicious purposes
(b) Violation of intellectual property rights
(c) Harassment, defamation or harm to others
(d) Submission of false or misleading information
(e) Distribution of viruses or other harmful code
(f) Collection of others' personal data without consent
(g) Spam, phishing or fraudulent activity
(h) Interference with the security of our services

We reserve the right to terminate access to our services for any violation.

Section 14 — Termination

These Terms remain in effect for as long as you use our services. We may terminate or suspend your access at any time for breach of these Terms or any other reason at our discretion. You may stop using our services at any time. Provisions that by their nature should survive termination — such as intellectual property, limitation of liability and applicable law — will continue to apply.

Section 15 — Warranty disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, except as required by Romanian law. We do not guarantee that the services will meet your expectations, be uninterrupted or error-free. The 2-year legal guarantee of conformity provided under GEO 140/2021 applies to all products as set out in our Refund Policy.

Section 16 — Limitation of liability

To the maximum extent permitted by law, EYE SOCIETY's liability for any direct or indirect loss arising from the use of our services is limited to the value of the products or services purchased. Nothing in these Terms limits or excludes liability for fraud, gross negligence, intentional misconduct or any other liability that cannot be excluded under Romanian law, including the legal guarantee of conformity.

Section 17 — Indemnification

You agree to indemnify and hold EYE SOCIETY harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms or your use of our services.

Section 18 — Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Section 19 — Waiver and entire agreement

Failure to enforce any provision of these Terms does not constitute a waiver of that provision. These Terms, together with the policies referenced here, constitute the entire agreement between you and EYE SOCIETY regarding your use of our services.

Section 20 — Assignment

We may assign or transfer our rights and obligations under these Terms to a third party without your prior consent. You may not assign your rights or obligations without our prior written consent.

Section 21 — Governing law and jurisdiction

These Terms are governed by Romanian law. Any dispute arising in connection with these Terms or our services is subject to the jurisdiction of the competent Romanian courts in Bucharest. As an alternative, EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform or, in Romania, the SAL platform.

Section 22 — Headings

The headings in these Terms are for convenience only and do not affect interpretation.

Section 23 — Modifications

We reserve the right to modify these Terms at any time. Changes take effect on publication on our website. Your continued use of our services after a change constitutes acceptance of the new Terms. We recommend reviewing these Terms periodically.
